Construction Law

Builders, subcontractors, developers and home owners — we get contracts back on track and recover what you are owed under the Home Building Act and Security of Payment legislation.

Whether you are a builder or subcontractor who has been unfairly pursued, or a home owner suffering from poor building work, we can help you find the correct path forward. If you are in the midst of a building and construction dispute you are already losing — fighting on too many fronts after investing heavily in the work or paying for it.

The law is clear that building work must be carried out to a proper and workmanlike standard, and that people should be fairly compensated to achieve that. Either way, you need to test and demonstrate the quality of the work, resolve the issues and work with the other party to bring the building to the standard it should be. That is why we can comfortably act for either side: the approach is the same — finish the job quickly and do not waste money in Court or NCAT.

We are very successful at getting contracts back on track. Where that is not possible, we know how to litigate efficiently and effectively to recover damages from those who failed to deliver what they promised.

How we help

Our clients range from builders and property developers to home owners who have had a hard time with renovations, across residential and commercial projects. It is always best to speak with a lawyer early.

  • Contract drafting and review — ensuring you get what you bargained for and your interests are protected.
  • Payment claims, schedules and debt recovery — extensive experience under the Building and Construction Industry Security of Payment Act 1999 (NSW), recovering outstanding debts or ensuring you only pay a fair price.
  • Dispute resolution and litigation — aiming first for an amicable resolution while always ready to fight, including statutory warranty claims under the Home Building Act 1989 and the Design and Building Practitioners Act 2020.
  • Liability claims and insurance — negligence and other liability claims, and guidance on insurance.
  • Strata and body corporate advice — matters under the Strata Schemes Management Act 2015 and community title schemes, resolved without going to NCAT where possible.
  • Risk and project management — our principal lawyer can be on call throughout your project to manage risk as issues arise.

We offer an initial, no-obligation conversation about your matter.
